DEPARTMENT ORDER NO. 208

 

SUBJECT :  DELEGATION OF AUTHORITY TO THE OFFICE OF THE GOVERNMENT CORPORATE COUNSEL TO HEAR AND RECEIVE EVIDENCE RELATIVE TO CLAIMS, DISPUTES AND CONTROVERSIES FILED PURSUANT TO BOOK IV, CHAPTER 14, OF THE ADMINISTRATIVE CODE OF 1987

 

 

 

In the interest of the service, and pursuant to the provision of existing law, the Office of the Government Corporate Counsel is hereby authorized to hear and receive evidence on cases involving claims, disputes or controversies between or among government-owned or controlled corporations being served by said Office filed on or after November 23, 1989 the date of effectivity of the Administrative Code of 1987 (E-0. No. 292), which cases, pursuant to Book IV, Chapter 14, of the aforesaid Code, shall be resolved by the Secretary of Justice. Upon termination of the hearing, the 'records of the case and the oral and documentary evidence received, together with the draft decision/resolution, shall be immediately forwarded to the Secretary of Justice for his consideration.

 

In line with settled Jurisprudence, the Office of the Government Corporate Counsel shall continue to hear and decide similar cases filed under P.D. No. 242 and over which it had assumed Jurisdiction prior to the effectivity of the aforesaid Code.

 

This Order takes effect immediately and shall remain in force until further orders.
